A driver accused of crashing into a bar and killing one woman was allegedly receiving oral sex at the time.
Alex Moreno, 32, of San Jose, Calif., was charged Wednesday with gross vehicular manslaughter and driving under the influence causing injury.
The San Jose Police Department alleges the construction worker was drunk, high and having the sex act performed on him when he backed his truck into the bar.
The construction worker was asked to leave the Agave Sports Bar & Grill because of his extreme drunkenness, states a police report obtained by the East Bay Times. He was also allegedly using cocaine in public and was seen trying to remove a woman’s top.
Witnesses allegedly saw Moreno and a 24-year-old woman walk to a nearby parking lot and get into his pickup truck.
The woman, whose identity has not been disclosed as she has not been charged, allegedly told investigators she began performing oral sex on Moreno and didn’t know the truck was moving.
Authorities say the truck reversed through the parking lot and barreled through the patio, before hitting a group of three people sitting at one of the outdoor tables. All three were pinned against the side of the restaurant.
Security guards immediately took action, one freeing the victims while others pulled Moreno out of the car and held him until police arrived.
Diana Prieto-Chacon, 35, was the most severely injured. She was taken to a nearby hospital where she was pronounced dead.
The men with her — one in his 30s, the other in his 40s — suffered serious leg injuries but are expected to survive.
Both Moreno and the woman, who had allegedly consumed several tequila shots, told police they did not recall the crash.
